These terms and conditions (the "Terms and Conditions") govern the use of www.tunuspace.ie (the "Site"). This Site is owned and operated by Third Space Pilates Limited, trading by the name Tunu Space Pilates. This Site is an ecommerce website.

By using this Site, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.

 

Intellectual Property
All content published and made available on our Site is the property of Third Space Pilates Limited and the Site's creators. This includes, but is not limited to images, text, logos, documents, downloadable files and anything that contributes to the composition of our Site.

 

Accounts
When you create an account on our Site, you agree to the following:

  1. You are solely responsible for your account and the security and privacy of your account, including passwords or sensitive information attached to that account; and

  2. All personal information you provide to us through your account is up to date, accurate, and truthful and that you will update your personal information if it changes.

We reserve the right to suspend or terminate your account if you are using our Site illegally or if you violate these Terms and Conditions.

 

Sale of Goods And Services
These Terms and Conditions govern the sale of goods and services available on our Site.

The following goods are available on our Site:

  • Exercise accesories.

We are under a legal duty to supply goods that match the description of the good(s) you order on our Site.

The following services are available on our Site:

  • Fitness classes.

  • Massage sessions

The services will be paid for in full when the services are ordered.

These Terms and Conditions apply to all the goods and services that are displayed on our Site at the time you access it. This includes all products listed as being out of stock. All information, descriptions, or images that we provide about our goods and services are as accurate as possible. 

 

We reserve the right to modify, reject or cancel your order whenever it becomes necessary. If we cancel your order and have already processed your payment, we will give you a refund equal to the amount you paid. You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund.

 

Subscriptions
Your subscription automatically renews and you will be automatically billed until we receive notification that you want to cancel the subscription.

To cancel your subscription, please fill out the cancellation form on the website page: Member's Corner. The terms and conditions of your membership contract will apply.

 

Payments
We accept the following payment methods on our Site:

  • Credit Card

  • Apple Pay

  • Google Pay

  • Direct Debit(SEPA)

  • Debit Card

When you provide us with your payment information, you authorise our use of and access to the payment instrument you have chosen to use. By providing us with your payment information, you authorise us to charge the amount due to this payment instrument.

If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.

Shipping and Delivery
When you purchase goods from our Site, the goods will be delivered through one of the following methods:

  • Pick up at studio.

 

Refunds
Refund requests must be made within 14 days after receipt of your goods.

Refunds do not apply to the following goods:

  • used items, items without original packaging and tags.

Consumer Protection Law
Where the Sale of Goods and Supply of Services Act 1980, or any other consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.

Our Site contains links to third party websites or services that we do not own or control. We are not responsible for the content, policies, or practices of any third party website or service linked to on our Site. It is your responsibility to read the terms and conditions and privacy policies of these third party websites before using these sites.

Limitation of Liability
Third Space Pilates Limited and our directors, employees and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site.

 

Indemnity
Except where prohibited by law, by using this Site you indemnify and hold harmless Third Space Pilates Limited and our directors, employees and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.

 

Applicable Law
These Terms and Conditions are governed by the laws of The Republic of Ireland.

Severability
If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.

Third Space Pilates Ltd (trading name:Tunu Space Pilates) values your privacy. The primary purpose of this Privacy Policy (“Policy”) is to describe our collection, use, and disclosure of information we collect about users of our website, www.tunuspace.ie (our “Website”), and our App (collectively for purposes of the Policy the “Services”). Our Services are operated by Tunu Space Pilates. By visiting the Website or using or downloading the App, you agree that your personal information will be handled as described in this Policy. Your use of our Website and App, and any dispute over privacy, is subject to this Policy, including its applicable limitations on damages and the resolution of disputes.

Important note about children’s privacy: We take children’s privacy very seriously. We do not intentionally gather personal information online from visitors who are under the age of 18. If a child under 18 submits personal information to Tunu Space Pilates online and we learn that the personal information is the information of a child under 18, we will attempt to delete the information as soon as possible, unless they are registered as a child account by their parent or guardian. If you believe that we might have any personal information collected online from a child under 18, please contact us at info@tunuspace.ie.

We collect information from you when you contact us, register with our Website or App, reserve classes, make a purchase, or otherwise interact with our Website or our App. The type of information that we collect varies based on your interaction with us and may include: your name, email address, password, and phone number, and, if you make a purchase from us, payment information, purchase history, injury history, birth date and shipping address. If you provide this information directly to one of our coaches or studio manager, we may associate this information with your account.

We automatically collect information about your use of our Website and App through cookies, web beacons, and other technologies, including technologies designed for mobile apps. We combine this information with other information we collect about you as well as use this information to identify you across your multiple devices. Please see the section “Cookies and Other Tracking Mechanisms” below for more information.

-The length of time you visit our Website.
-The referring URL or the webpage that led you to our Website.

App:
-Mobile device ID; device name and model; operating system type, name, and version.
Language information.
-Activities within the App; and the length of time that you are logged into our App.
-General Location information. You may turn off this feature through the location settings on your mobile device.
-With your permission, we may access your mobile device’s calendar to help you keep track of your upcoming classes.

-To provide our information to you, to communicate with you about your use of our services, to respond to your inquiries, to fulfill your orders, and for other customer service purposes.

For example, we share your information, in the aggregate, with third parties to assist us in advertising our products and services and to assist us in determining relevant advertising. These third parties may include entities that assist us and other companies with communicating with you and serving advertisements to you, including advertisements on third party websites, social media platforms, as well as through push notifications and email.

Clear GIFs, pixel tags and other technologies: Clear GIFs are tiny graphics with a unique identifier, similar in function to cookies. In contrast to cookies, which are stored on your computer’s hard drive, clear GIFs are embedded invisibly on web pages. We may use clear GIFs (a.k.a. web beacons, web bugs, or pixel tags), in connection with our Website and our App to, among other things, track the activities of our Website visitors and App users, help us manage content, and compile statistics about Website and App usage. Any access to and use of such linked websites is not governed by this Policy, but instead is governed by the privacy policies of those third-party websites. 6. Security and Access of Personal Information

Security of Your Personal Information: We have implemented commercially reasonable precautions to protect the information we collect from loss, misuse, and unauthorized access, disclosure, alteration, and destruction. Please be aware that despite these measures, no data security measures can guarantee security.

You should take steps to protect against unauthorized access to your password, phone, and computer by, among other things, signing off after using a shared computer, choosing a robust password that nobody else knows or can easily guess, and keeping your log-in and password private. We are not responsible for any lost, stolen, or compromised passwords or for any activity on your account via unauthorized password activity.

Access to Your Personal Information: You may modify personal information that you have submitted by logging into your account and updating your profile information. Please note that copies of information that you have updated, modified or deleted may remain viewable in cached and archived pages of the Site or App for a period of time.

Promotional Emails: We may send periodic promotional emails to you. You may opt-out of our promotional communications by following the opt-out instructions contained in the email. Please note that it may take up to 10 business days for us to process opt-out requests. If you opt-out of receiving promotional emails about recommendations or other information we think may interest you, we may still send you emails about your account or any Services you have requested or received from us.
